TUPE Regulations

On 31st January 2014, the Collective Redundancies and Transfer of Undertakings (Protection of Employment) (Amendment) Regulations 2014 came into force.

The regulations provide important protection to employees when the business or undertaking for which they work is transferred to a new employer. Amongst the changes are:-

  1. A change to the circumstances in which dismissals will be considered automatically unfair;
  2. An increase in the time by which employer “employee liability information” must be provided from the old employer to the new employer (this provision will apply to transfers which take place on or after 1st May 2014);
  3. An amendment to the definition of “service provision change”
